The Platform and the Service are providedto yousubject to these " DIAL NUMBER " Terms of Use(these"Terms"). For the purpose of the Terms and wherever the contextsorequires, the terms "you" and "your" shall mean anypersonwho uses or accesses, whether through manual or automated means, thePlatformor the Service in any manner whatsoever including persons browsing thePlatformand its content, posting comments or any content or responding toanyadvertisements or content on the Platform. By using the Service, you agreetocomply with these Terms. Additionally, when using a portion of the Service,youagree to conform to any applicable posted guidelines for such Service,whichmay change or be updated from time to time at " DIAL NUMBER "ssolediscretion. You understand and agree that you are solely responsibleforreviewing these Terms from time to time. Should you object to any termorcondition of these Terms, any guideline, or any subsequent changes theretoorbecome unhappy with " DIAL NUMBER " or the Service in any way,youronly choice is to immediately discontinue use of " DIAL NUMBER".These Terms may be updated by " DIAL NUMBER " at any time atits solediscretion. " DIAL NUMBER " may send you notices of changesto thePlatform or the Terms pursuant to Section xxi (I) herein. " DIALNUMBER" may provide a translation of the English version of the Terms intootherlanguages. You understand and agree that any translation of the Termsintoother languages is for your convenience only and that the Englishversiongoverns the terms of your relationship with " DIAL NUMBER".Furthermore, if there are any inconsistencies between the Englishversion ofthe Terms and any translation, the English version of the Terms shallgovern.

DIAL NUMBER. You understand that DIALNUMBER doesnot control, and is not responsible for ads, directory information,businesslistings/information, messages between users, including withoutlimitatione-mails sent from outside DIAL NUMBER’s domain or other means ofelectroniccommunication, whether through the Platform or another Third PartyWebsite(defined below) or offerings, comments, user postings, files, images,photos,video, sounds, business listings/information and directory information oranyother material made available through the Platform and theService("Content"), and that by using the Platform and the Service,you maybe exposed to Content that is offensive, indecent, inaccurate,misleading, orotherwise objectionable. You acknowledge and agree that you areresponsible forand must evaluate, and bear all risks associated with, the useof any Content,that you may not rely on said Content, and that under nocircumstances will" DIAL NUMBER " be liable in any way for the Contentor for any lossor damage of any kind incurred as a result of the browsing,using or readingany Content listed, e-mailed or otherwise made available viathe Service. Youacknowledge and agree that " DIAL NUMBER " cannot anddoes notpre-screen or approve any Content, but that " DIAL NUMBER "has theright, in its sole and absolute discretion, to refuse, delete or moveanyContent that is or may be available through the Service, for violatingtheseTerms and such violation being brought to " DIAL NUMBER "’s knowledgeorfor any other reason or no reason at all. If you link to Third Party Websites, you may besubject tothose Third Party Websites’ terms and conditions and other policies." DIALNUMBER " makes no representation or guarantee as to theaccuracy orauthenticity of the information contained in any such Third PartyWebsite, andyour linking to any other websites is completely at your own riskand "DIAL NUMBER " disclaims all liability thereto.

C. You acknowledge and agree that you aresolelyresponsible for your own Content posted on, transmitted through, orlinked fromthe Service and the consequences of posting, transmitting, linkingor publishingit. More specifically, you are solely responsible for all Contentthat youupload, email or otherwise make available via the Service. Inconnection withsuch Content posted on, transmitted through, or linked from theService by you,you affirm, acknowledge, represent, warrant and covenant that:(i) you own orhave and shall continue to, for such time the Content isavailable on thePlatform, have the necessary licenses, rights, consents, andpermissions to usesuch Content on the Service and Platform (including withoutlimitation allpatent, trademark, trade secret, copyright or other proprietaryrights in and toany and all such Content) and authorize " DIAL NUMBER" to use suchContent to enable inclusion and use of the Content in themanner contemplated bythe Service, the Platform and these Terms; and (ii) youhave the writtenconsent, release, and/or permission of each and everyidentifiable individualperson or business in the Content to use the name orlikeness of each and everysuch identifiable individual person or business toenable inclusion and use ofthe Content in the manner contemplated by theService, the Platform and theseTerms. For clarity, you retain all of yourownership rights in your Content;however, by submitting any Content on thePlatform, you hereby grant to "DIAL NUMBER " an irrevocable,non-cancellable, perpetual, worldwide,non-exclusive, royalty-free,sub-licensable, transferable license to use,reproduce, distribute, preparederivative works of, display, and perform theContent in connection with thePlatform and " DIAL NUMBER "'s (and itssuccessors') business,including without limitation for the purpose of promotingand redistributingpart or all of the Platform and Content therein (andderivative works thereof)in any media formats and through any media channelsnow or hereafter known.These rights are required by " DIAL NUMBER "in order to host anddisplay your Content. Furthermore, by you posting Contentto any public area ofthe Service, you agree to and do hereby grant to "DIAL NUMBER " allrights necessary to prohibit or allow any subsequentaggregation, display,copying, duplication, reproduction, or exploitation of theContent on theService or Platform by any party for any purpose. As a part ofthe Service," DIAL NUMBER " may offer the facility of automaticallycapturing ofthe "Description" of your ad based on the images uploadedby you." DIAL NUMBER " makes no warranty the veracity or the accuracyof thegenerated Description. The Description may be edited by you at any timewhileyour ad is live. You also hereby grant each user of the Platform (a)anon-exclusive license to access your Content through the Platform; and (b) therightto contact you with regard to the Content posted by you through privatechat orany other means. The foregoing license to each user granted by youterminatesonce you or " DIAL NUMBER " remove or delete such Contentfrom thePlatform. Further, you grant " DIAL NUMBER " the right tomakeavailable your Content to any third party in connection with thetransactioncontemplated in your classified advertisement.

D. " DIAL NUMBER " does notendorse anyContent or any opinion, statement, recommendation, or adviceexpressed therein,and " DIAL NUMBER " expressly disclaims any andall liability inconnection with user Content. " DIAL NUMBER " doesnot permitcopyright infringing activities and infringement of intellectualproperty rightson the Platform, and " DIAL NUMBER " may, at its solediscretion,remove any infringing Content if properly notified in accordancewith applicablelaw that such Content infringes on another's intellectualproperty rights." DIAL NUMBER " reserves the right to remove anyContent without priornotice. " DIAL NUMBER " may also terminate auser's access to thePlatform, if they are determined to be a repeat infringeror found to beindulging in any act contrary to these Terms. A repeat infringeris a user whohas been notified of infringing activity more than twice and/orhas had a usersubmission removed from the Platform more than twice. Further,at its solediscretion, " DIAL NUMBER " reserves the right to decidewhether anyContent is appropriate and complies with these Terms.

iii. CONDUCT

You agree not to post, email, host,display, upload,modify, publish, transmit, update or share any information onthe Site, orotherwise make available Content:

i. that violates any law or regulation;

ii. that is copyrighted or patented,protected bytrade secret or trademark, or otherwise subject to third partyproprietaryrights, including privacy and publicity rights, unless you are theowner of suchrights or have permission or a license from their rightful ownerto post thematerial and to grant DIALNUMBER all of the license rights grantedherein;

iii. that infringes any of theforegoingintellectual property rights of any party, or is Content that you donot have aright to make available under any law, regulation, contractual orfiduciary relationship(s);

iv. that is harmful, abusive, unlawful,threatening,harassing, blasphemous, defamatory, obscene, pornographic,paedophilic , libelous , invasive ofanother's privacy or other rights, hateful, orracially, ethnicallyobjectionable, disparaging, relating or encouraging moneylaundering or illegalgambling or harms or could harm minors in any way orotherwise unlawful in anymanner whatsoever;

v. that harasses, degrades, intimidates orishateful towards any individual or group of individuals on the basis ofreligion,gender, sexual orientation, race, ethnicity, age, or disability;

vi. that violates any (local) equalemployment laws,including but not limited to those prohibiting the stating, inany advertisementfor employment, a preference or requirement based on race,color, religion, sex,national origin, age, or disability of the applicant.

vii. that threatens the unity, integrity,defense,security or sovereignty of India, friendly relations with foreignstates, orpublic order or causes incitement to the commission of any  cognisableoffence or prevents investigationof any offence or is insulting any othernation;

viii. that includes personal oridentifyinginformation about another person without that person's explicitconsent;

ix. that impersonates any person orentity,including, but not limited to, an Dialnumber employee, or falsely statesorotherwise misrepresents an affiliation with a person or entity;

x. deceives or misleads the addressee abouttheorigin of such messages or communicates any information which isgrosslyoffensive or menacing in nature;

xi. that is false, deceptive, misleading,deceitful, misinformative, orconstitutes "bait and switch" offer;

xii. that constitutes or contains"pyramidschemes," "affiliate marketing," "linkreferral code,""junk mail," "spam," "chainletters," orunsolicited advertisements of a commercial nature;

xiii. that constitutes or contains any formofadvertising or solicitation if (1) posted in areas or categories of thePlatformwhich are not designated for such purposes; or (2) e-mailed toDialnumber userswho have requested not to be contacted about other services,products orcommercial interests;

xiv. that includes links to commercialservices orThird Party Websites, except as specifically allowed by Dialnumber;

xv. that advertises any illegal services orthe saleof any items the sale of which is prohibited or restricted byapplicable law,including without limitation items the sale of which isprohibited or regulatedby applicable law;

xvi. that contains software viruses or anyothercomputer code, files or programs designed to interrupt, destroy or limitthefunctionality of any computer software or hardware ortelecommunicationsequipment or any other computer resource;

xvii. that disrupts the normal flow ofdialogue withan excessive number of messages (flooding attack) to the Service,or thatotherwise negatively affects other users' ability to use the Service;or

xviii. that employs misleading emailaddresses, orforged headers or otherwise manipulated identifiers in order todisguise theorigin of Content transmitted through the Service.

Additionally, you agree not to:

xix. contact anyone who has asked not tobecontacted, or make unsolicited contact with anyone for any commercialpurpose,specifically, contact any user to post advertisement on a third partywebsiteor post any advertisement on behalf of such user; or to"stalk" orotherwise harass anyone;

xx. make any libellous or defamatorycomments orpostings to or against anyone;

xxi. collect personal data about otherusers orentities for commercial or unlawful purposes;

xxii. use automated means, includingspiders,robots, crawlers, data mining tools, or the like to download or scrapedata fromthe Service, except for internet search engines (e.g,. Google)andnon-commercial public archives (e.g. archive.org) that comply withourrobots.txt file;

xxiii. post Content that is outside thelocal areaor not relevant to the local area, repeatedly post the same orsimilar Content,or otherwise impose unreasonable or disproportionately largeloads on ourservers and other infrastructure;

xxiv. post the same item or service inmultipleclassified categories or forums, or in multiple metropolitan areas;

xxv. attempt to gain unauthorized access tocomputersystems owned or controlled by Dialnumber or engage in any activitythatdisrupts, diminishes the quality of, interferes with the performance of,orimpairs the functionality of, the Service or the Platform.

xxvi. use any form of automated device orcomputerprogram (sometimes referred to as "flagging tools") thatenables theuse of Dialnumber's "flagging system" or other communitycontrolsystems without each flag being manually entered by a human thatinitiates theflag (an "automated flagging device"), or use any suchflagging toolto remove posts of competitors, other third parties or to removeposts without areasonable good faith belief that the post being flaggedviolates these Terms orany applicable law or regulation.

xxvii. use any automated device or softwarethatenables the submission of automatic postings on Dialnumber withouthumanintervention or authorship (an "automated posting device"),includingwithout limitation, the use of any such automated posting device inconnectionwith bulk postings, or for automatic submission of postings atcertain times orintervals; or

xxviii. Any Content uploaded by you shallbe subjectto relevant laws and may disabled, or and may be subject toinvestigation underappropriate laws. Furthermore, if you are found to be innon-compliance with thelaws and regulations, these terms, or the privacypolicy of the Site, we mayterminate your account/block your access to the Siteand we reserve the right toremove any non-compliant Content uploaded by you.

iv. PAID SERVICES

Dialnumber may charge a fee to post Contentin someareas of the Service ("Paid Services") . The fee permitscertainContent to be posted in a designated area of the Platform or in excessof limitsset by Dialnumber. Each party posting Content to the Service isresponsible forsaid Content and compliance with the Terms. Any such fees paidhereunder arenon-refundable in the event any Content is removed from theService forviolating these Terms. Paid Services are subject to the Terms listedherein, aswell as the additional terms of service, which can be viewed .

v. POSTING AGENTS

As used herein, the term "PostingAgent"refers to a third-party agent, service or intermediary that offersto postContent to the Service on behalf of others. Dialnumber prohibits theuse ofPosting Agents, directly or indirectly, without the express writtenpermissionof Dialnumber. In addition, Posting Agents are not permitted to postContent onbehalf of others, directly or indirectly, or otherwise access theService inorder to post Content on behalf of others, except with expresswrittenpermission or license from Dialnumber.

vi. ACCESS TO THE SERVICE

Dialnumber grants you a limited,revocable,non-exclusive license to access and use the Service for personal use.Thislicense granted herein does not include any of the following: (a) access tooruse of the Service by Posting Agents; or (b) any collection,aggregation,copying, duplication, display or derivative use of the Service norany use ofdata mining, robots, spiders, or similar data gathering andextraction toolsfor any purpose unless expressly permitted by Dialnumber or asotherwise setforth in these Terms. Notwithstanding the foregoing, generalpurpose internetsearch engines and non-commercial public archives that gatherinformation forthe sole purpose of displaying hyperlinks to the Service,provided they each doso from a stable IP address or range of IP addresses usingan easilyidentifiable agent and comply with our robots.txt file, may engage intheactivities set forth in (b). For purposes of this exception, a"generalpurpose internet search engine" does not include a website orsearchengine or other service that specializes in classified listings includinganysubset of classifieds listings such as housing, for sale, jobs, services,orpersonals, or which otherwise provides classified ad listing services.Thelicense set forth in this Section permits you to display on your website,orcreate a hyperlink thereto, individual postings on the Service so long assuchuse is for non-commercial and/or news reporting purposes only (e.g., foruse inpersonal blogs or other personal online media). If the total number ofsuchpostings displayed on or linked to your website exceeds limits setbyDialnumber, your use will be considered to be in violation of theseTerms,unless Dialnumber expressly grants you permission otherwise. You arealsopermitted to create a hyperlink to the home page of the Platform so long asthelink does not portray Dialnumber, its employees, affiliates or agents inafalse, confusing, misleading, derogatory, or otherwise offensive matter. Useofthe Service beyond the scope of authorized access as set forth in theseTermsimmediately terminates any permission or license granted herein. In ordertocollect, aggregate, copy, duplicate, display or make derivative use oftheService or any Content made available via the Service for otherpurposes(including commercial purposes) not stated herein, you must firstobtain alicense from Dialnumber.
